Rep. Andy Ogles Drafts Article of Impeachment Against Longtime Democrat Activist Judge Over Ruling That DOGE Likely Violated Constitution by Shutting Down USAID

Representative Andy Ogles (R-TN) has drafted an Article of Impeachment against radical activist U.S. District Judge Theodore Chuang.

This decisive action comes in direct response to Judge Chuang’s recent ruling, which obstructed the Trump administration’s efforts to streamline government operations by dismantling the U.S. Agency for International Development (USAID).

Judge Chuang, an appointee of Barack Obama, issued a 68-page opinion asserting that the Department of Government Efficiency’s (DOGE) initiative to dissolve USAID likely violated the Constitution.

He ordered the restoration of email and computer access to all USAID employees, including those placed on administrative leave, effectively halting the administration’s cost-cutting measures.

Representative Ogles asserts that Judge Chuang’s ruling oversteps judicial boundaries and undermines the executive branch’s authority to manage federal agencies.

In a post on X, Ogles wrote, “An Obama appointee and lifelong Democrat who blocked Trump’s travel ban in 2017. This judge literally peddled critical race theory as editor of the Harvard Law Review. Now he’s trying to save USAID, which gives money to terrorist and radical LGBTQ+ propaganda. Impeach him!”

On Friday, Rep. Andy Ogles announced he is drafting new articles of impeachment against activist Judge Theodore Chuang.

According to the Article of Impeachment:

RESOLUTION

Impeaching Theodore Chuang, a judge of the United States District Court for the District of Maryland, for high crimes and misdemeanors.

Resolved, That Theodore Chuang, a judge of the United States District Court for the District of Maryland, is impeached for high crimes and misdemeanors, and that the following article of impeachment be exhibited to the Senate:

Article of impeachment exhibited by the House of Representatives of the United States of America in the name of itself and of the people of the United States of America, against Theodore Chuang, a judge of the United States District Court for the District of Maryland, in maintenance and support of its impeachment against him for high crimes and misdemeanors.

ARTICLE I

Theodore Chuang, a judge of the United States District Court for the District of Maryland, engaged in a pattern of conduct that is incompatible with the trust and confidence placed in him as a Federal judge as follows:

Judge Chuang, in his memorandum opinion on March 18, 2023, related to the case J. Does 1 v. Elon Musk, et al., issued a preliminary injunction ordering, among other things, the government “to reinstate access to email, payments, security notifications, and other electronic systems, which were improperly deleted, causing plaintiffs to lose USAID employees and PSCs.”

In issuing a temporary restraining order requiring provision of systems access to these employees and PSCs, Judge Chuang has without merit marginalized the President’s Article II authority which vests the power to conduct foreign policy in the President of the United States.

This includes the designation of persons or powers – which prevents the President from refusing to provide continued systems access requested by USAID employees who have, among other things, disbursed funds to organizations linked to Foreign Terrorist Organizations – is entirely inconsistent with serving the United States as a district court judge.

Judge Chuang, in mandating the immediate provision of access to government systems without regard for the President’s duty under Article II to defend the national security of the United States, has done so in a manner that is arbitrary and capricious.

Judge Chuang mandated such access without regard for the troubled history of foreign assistance through the United States Agency for International Development (USAID).

A March 2021 GAO report indicates that from FY2015 until FY2019, USAID did not consistently ensure that subawards provided for projects in the Gaza Strip and Jordan and Somalia complied with regulations aimed at preventing financial misuse by terrorist groups.

More recently, in November 2021, USAID was found to have financed hundreds of thousands of meals for al-Qaida affiliated fighters in Syria. While arguing that the Trump Administration’s reorganization of USAID caused “irreparable harm” to the plaintiffs, Judge Chuang failed to consider that his decisions could easily inflict “irreparable harm” on Americans and America.

Accordingly, Judge Theodore Chuang has engaged in such conduct as to bring the concern for the separation of powers and the national security of the United States that he is guilty of high crimes and misdemeanors, is unfit to hold the office of Federal judge, and should be removed from office.
