A federal appeals court on Thursday responded to fired special counsel Hampton Dellinger’s request to dismiss his case as moot after he withdrew his litigation earlier this month.

President Trump fired Hampton Dellinger, the Special Counsel for the Office of Special Counsel last month, however, the Biden holdover continued to fight Trump in court and was successful because the case was assigned to a corrupt Obama judge.

The appeals court previously granted a motion to stay Judge Amy Berman Jackson’s order reinstating the Biden holdover.

Following the ruling from the DC Circuit Court, Hampton Dellinger said he was ending his legal fight with Trump.

“I’m ending my legal battle so my time as Special Counsel and head of the U.S. Office of Special Counsel (OSC) is now over,” Hampton Dellinger wrote in a statement.

Earlier this month Hampton Dellinger tried to stop the appeals court from issuing a ruling but the DOJ fought back.

The DOJ accused Hampton Dellinger of attempting to “prevent the issuance” of an opinion from the appeals court.

Hampton Dellinger filed a shocking motion to dismiss his appeal in his latest effort to block the court from issuing a ruling.

“Hampton Dellinger moves to dismiss the appeal because it is moot, with each side to bear its own costs,” Hampton Dellinger’s attorneys wrote.

Dellinger lost when the DC Circuit Court of Appeals granted the government’s motion for a stay pending appeal.

Hampton Dellinger took another hit on Thursday after the appeals court’s latest order.

On Thursday, the DC Circuit Court of Appeals told Hampton Dellinger they will dismiss the lower court with prejudice.

BREAKING: D.C. Court of Appeals tells Dellinger okay, you want to play that game, fine, we’ll dismiss the lower court WITH prejudice, but NOT our opinions. 1/ pic.twitter.com/1WJtBZxtNr

This is a major loss for Hampton Dellinger. He will not be able to refile the case.

3/ Instead it dismissed case WITH prejudice meaning Dellinger can’t try to refile AND it vacated injunction entered below which was still in place but stayed AND it left binding precedent of Court of Appeals in tact. So, really a WIN for Trump, or rather a BIG L for Dellinger.
