Republican Senator Jim Banks and Democrat Senator Ruben Gallego have introduced legislation to keep men out of sororities and protect women’s spaces on college campuses.
The Freedom of Association in Higher Education Act of 2025 is a bipartisan bill that aims to safeguard college students’ rights to form and join single-sex social organizations, such as fraternities, sororities, and off-campus clubs, without facing discrimination or punishment from the institutions they attend.
The legislation would “protect any student in a single-sex social organization” by “limiting membership only to individuals of one sex.”
“Students should be free to form and join single-sex organizations like fraternities and sororities without facing punishment. This bill protects students’ freedom to associate, uphold tradition, and choose the communities they want to be a part of,” Senator Banks said in a statement.
The bill has gained support from key organizations in the Greek life community, including the North American Interfraternity Conference (NIC) and the National Panhellenic Conference (NPC).
NIC CEO Jud Horras praised Senators Banks and Gallego for their commitment to protecting students’ rights, noting that single-sex organizations also help college men “shape their futures” and build meaningful communities.
In 2023, six members of the Kappa Kappa Gamma sorority at the University of Wyoming sued their national organization for admitting a transgender student. The sorority girls said that the man would engage in troubling behavior, including staring at them while they returned from showers and often having “an erection visible through his leggings.”
Ultimately, a federal judge ruled that he could not be kicked out of the sorority, despite his gross behavior.
