ANOTHER WIN FOR TRUMP: Appeals Court Smacks Down Obama Judge, Dismisses Democrat States’ Lawsuit Challenging Mass Firings of Probationary Workers

Another win for President Trump.

A federal appeals court on Monday dismissed a lawsuit filed by Democrat state attorneys general challenging the mass firing of probationary workers.

The Fourth Circuit Court of Appeals, in a 2-1 decision, said the 19 blue states did not have the legal standing to sue the Trump Administration over mass firings.

A federal appeals court on Monday rejected a lawsuit filed by a group of states that challenged the mass firings of thousands of federal probationary workers.

The U.S. Court of Appeals for the Fourth Circuit divided 2-1 in finding that the 19 states and the District of Columbia did not have legal standing to sue over the large-scale terminations. The appeals court sent the case back to the federal district court with directions to dismiss it.

“We acknowledge that the abrupt and indiscriminate dismissal of the probationary employees here exacted all-too-human costs upon those affected,” Judge Harvie Wilkinson wrote for the two-judge majority. “But this real impact on the employees, who are not parties here, cannot govern our review.”

Wilkinson wrote that while federal probationary workers “suffered the brunt of the harm” as a result of their firings, “they are nowhere to be found in this case.”

Joining Wilkinson in the majority was Judge Allison Jones Rushing. Judge DeAndrea Gist Benjamin dissented.

President Trump previously fired tens of thousands of probationary workers as he worked to downsize the federal government and cut waste.

Earlier this year, a federal judge ordered the Trump Administration to rehire approximately 20,000 probationary workers across 18 different agencies.

US District Judge James Bredar, an Obama appointee, said the Trump Administration cannot conduct massive layoffs without warning the workers.

“When the federal government terminates large numbers of its employees, including those still on probation because they were recently hired or promoted, it must follow certain rules,” the judge wrote in a 56-page order. “Some of those rules are intended to help states manage the consequences of sudden, mass layoffs.”

In April, the Fourth Circuit Court of Appeals cleared the way for President Trump to fire thousands of probationary workers and heard arguments in the Spring.

On Monday, the Virginia-based Fourth Circuit Court of Appeals finally dismissed the lawsuit against the Trump Administration.
