Georgia Supreme Court Declines to Hear Fani Willis’s Attempts to Reinstate Herself in Junk RICO Case Against Trump and Defendants

In a 4-3 decision, the Georgia Supreme Court this morning declined to hear Fulton County District Attorney Fani Willis’s attempts to reinsert herself into the racketeering case against President Trump and his co-defendants over the 2020 Presidential election.

Willis came under scrutiny after it was revealed she was romantically involved with the lead prosecutor, Nathan Wade.  Wade was paid over $650,000 from 2021 through 2023 while the other prosecutors, John Floyd and Anna Cross, were paid $73,000 and $91,000 respectively for the same time period.  This was attributed to more billable hours, but also to a $250 per hour rate for Wade while Floyd’s firm was initially billing $100 per hour less.  Eventually the fees aligned.

Prior to his appointment, there was no previous record of Wade prosecuting racketeering cases and “scant evidence” of prosecuting any major cases, according to the New York Times. Floyd, however, not only had considerable experience prosecuting RICO cases, he also wrote a book titled RICO State By State: A Guide to Litigation Under the State Racketeering Statutes.

In March 2024, Judge Scott McAfee initially ruled that either Willis had to recuse herself from the case or Wade would have to resign.  Wade ultimately resigned, initially allow Willis to continue.  However, in December 2024, the Georgia Court of Appeals ruled 2-1 that Willis had already undermined the case and disqualified her from the prosecution.

The Prosecuting Attorneys’ Council of Georgia will now be tasked with appointing a new prosecutor, who will be afforded the option to continue the case in its entirety, drop certain charges, or dismiss the case completely.

Any prosecution against President Trump would likely be postponed until his time serving as President comes to an end.
