JUST IN: Judge Xinis Postpones Discovery in Kilmar Abrego Garcia Case

Judge Paula Xinis postponed discovery in Kilmar Abrego Garcia for one week in response to the Trump Administration’s request for a delay.

The judge did not give a reason for her decision to postpone the discovery.

“The Court has reviewed Defendants’ Motion to Stay and Plaintiffs’ Response. With the agreement of parties, the Court hereby ORDERS that discovery shall be stayed until April 30, 2025, at 5:00 PM,” the judge wrote.

On Wednesday morning the Trump DOJ in a sealed motion asked the judge to pause discovery in the case for seven days.

On Tuesday evening Judge Paula Xinis, an Obama appointee, went off on the Trump Administration after a conference to address the government’s dispute over discovery in the Kilmar Abrego Garcia case.

Kilmar Abrego Garcia is an El Salvadorian national who was illegally residing in Maryland. In 2019, an immigration judge ordered Abrego Garcia, an alleged member of the dangerous MS-13 gang, removed from the US.

Abrego Garcia was deported to El Salvador’s notorious CECOT prison and the judge is trying to force the Trump Administration to reveal details of diplomatic discussions.

The judge accused the Trump Administration of defying her court order and ordered the government to provide more details by Wednesday about its decision to send Abrego Garcia to CECOT.

Judge Xinis accused the Trump Administration of acting in “bad faith” and ‘obstructing’ efforts to gather more information on its decision to send Abrego Garcia to CECOT.

“Defendants’ objection reflects a willful and bad faith refusal to comply with discovery obligations. The objection is overruled. Defendants are therefore ordered to supplement their answers in full compliance with the Federal Rules of Civil Procedure. Their answers must include facts responsive to the requests, not oblique and incomplete, non-specific characterizations,” Judge Xinis wrote in an 8-page order reviewed by The Gateway Pundit.
