President Donald Trump told reporters Monday that he is ready to invoke the Insurrection Act of 1807 “if it was necessary” to restore order in American cities and protect citizens, a move that would mark an extraordinary exercise of presidential authority and escalate the federal clash with several Democratic governors and city officials.

“I do it if it was necessary. So far, it hasn’t been necessary. But we have an Insurrection Act for a reason,” Trump said from the Oval Office.

“If I had to enact it, I’d do that. If people were being killed and courts were holding us up or governors or mayors were holding us up, sure, I’d do that. I want to make sure that people aren’t killed. We have to make sure that our cities are safe.”

The president’s warning comes amid a fierce legal and political fight over the deployment of federal and National Guard forces to cities where the administration says violent unrest and attacks on federal officers have spiraled out of control.

Trump-appointed Judge Karin Immergut, for the second time on Monday, blocked President Trump from sending troops to quell the violence in lawless Portland, Oregon.

Illinois and the city of Chicago on Monday also filed suit to block plans to federalize and deploy Guard units to the city. However, US District Judge April Perry, a Biden appointee, declined to issue a Temporary Restraining Order (TRO) and set a hearing on the case for Thursday.

The Insurrection Act of 1807 grants the president extraordinary power to deploy active duty military and federalize the National Guard in certain extreme circumstances, typically when states are unable or unwilling to suppress insurrection, rebellion, or domestic violence.

President Trump, immediately after taking office on day one, signed an executive order designating cartel groups as Foreign Terrorist Organizations (FTOs) and Specially Designated Global Terrorists (SDGTs). He further signed an executive order, declaring a national emergency on the Southern Border.

White House Deputy Chief of Staff Stephen Miller hinted earlier this year that Trump may also invoke the Insurrection Act to combat the cartels in line with the “national objective of eradicating their physical presence on US soil.”
